The driver of the rear vehicle is always 'at fault'. The car behind has a duty to maintain a safe stopping distance (whether you were moving or not) and they should have noticed the traffic ahead. Drivers should always be able to stop in the distance without hitting the car in front. Have been involved in a roundabout accident which has been settled 50/50 by your Insurer ?
Most roundabout accidents are settled this way but if there is good evidence to demonstrate that the other driver was fully to blame this should be challenged. Did you know that if you just leave your claim to be handled by your insurance company it is not unheard of for them to settle your claim on a 50/50 basis without your knowledge. We prevent that happening by liaising with both insurance companies on your behalf, ensuring a fair settlement of the claim.
Has your parked car been hit by a stolen car and who pays ? You cannot be held responsible for damage to your car if it was parked. The claim will be against the insurer of the stolen vehicle, or possibly the MIB (Motor Insurers Bureau) which will act as the insurer of last resort. But that is for your insurer to sort out: just because your vehicle was damaged by a car that was stolen, will not get the insurer of the stolen car off the hook and you should be compensated. | |
